DRAFT — lawyer review required
This page captures Tuur’s intended policy in plain language to brief a lawyer. It has not been reviewed by counsel and must not be relied upon as legal advice. [TODO: review] tags mark questions for counsel.
The agreement between Tuur and guides who sign up for a membership. By creating a guide account or paying for a plan, you accept these terms.
Tuur is operated by Matthew RobinsonTODO: confirm legal trading entity — sole-trader vs. UG/GmbH vs. Ltd, and address used on the Impressum. The platform listed at tuur.guide is a directory: we publish guides’ profiles, accept enquiries on their behalf, and bill guides for memberships. We do not operate tours, take bookings, or process payment from travellers.
Memberships are available to independent tour guides offering services to consumers. Companies, agencies, and OTAs are out of scope for the current product.TODO: confirm we can restrict membership to natural persons / micro-businesses under EU competition rules
Memberships are billed monthly or annually. Prices are shown on the /pricing page and include VAT where applicable.TODO: confirm VAT treatment for B2C vs. B2B sales across EU/UK/RoW; B2B reverse-charge for VAT-registered guides outside DE
Annual plans are charged in a single up-front payment for the period. Monthly plans renew automatically each month until cancelled.
You can cancel any time from the dashboard. Cancellation takes effect at the end of the current billing period; we do not pro-rate refunds for unused time within a paid period.TODO: confirm Widerrufsrecht (14-day cooling-off right) for first signup; whether it applies to digital services delivered immediately; how to draft the consumer waiver if so
Listings must be accurate and lawful. See the full listing rules. We reserve the right to suspend or remove listings that violate them.
When a traveller contacts a guide through Tuur, we forward the enquiry; that’s the extent of our involvement. The contract for the tour is between the traveller and the guide. We do not guarantee bookings, payment, or the conduct of either party, and we are not a party to any agreement they form.
We provide the platform “as is”. To the maximum extent permitted by law, our liability for any single claim is capped at the membership fees you paid us in the 12 months before the event.TODO: liability caps under German consumer law (BGB §309) — confirm enforceability for B2C and B2B variants
We can suspend or close an account that breaches these terms or the listing rules. We’ll usually give you a chance to fix the issue first unless the breach is serious (fraud, illegal content, safety risk).
We may update these terms. Material changes will be announced 30 days in advance by email; minor changes (typo fixes, clarifications) take effect immediately.TODO: confirm 30 days is sufficient under German law for B2C; some guidance suggests 6 weeks
These terms are governed by the law ofTODO: jurisdiction — Germany if Matthew operates from there; consider mandatory consumer-protection law of guide’s home country. Disputes go to the competent courts of that jurisdiction, subject to any mandatory consumer-protection rules of the guide’s home country.
